There is hereby created a Commission to be known and designated as the Planning Commission of the City, which Commission shall consist of seven (7) members to be appointed by a majority vote of the Governing Body. All members shall be residents and taxpayers of Anderson County, Kansas; two of the members may reside outside of the City and the remaining members shall reside within the City. Each member’s term of appointment shall be for a period of three (3) years. The terms of appointment and the appointees holding positions on the Planning Commission at the effective date of this provision shall continue until each term’s expiration. Future appointments shall be made so as to maintain the same rotation of appointments, which is to say a cycle of three (3) appointments in one year followed by two (2) appointments in each of the two years immediately subsequent thereto.

The Commission shall, when there is business to transact, hold a meeting at least once a month, or more often as may be necessary to fulfill the duties of the Commission.

The Planning Commission shall adopt such rules and regulations as it may deem necessary to carry into effect the provisions and purposes of this article. It shall hold such meetings and meet at such places from time to time and have such hearings as the Commission, or a majority thereof, may determine. At the first meeting of the Commission after this article takes effect, the Commission shall elect one of their number Chairman, and thereafter on May 1 of each year the Commission shall meet and organize by electing a member to serve as Chairman for one year.

The Planning Commission shall recommend the boundaries of the various districts and appropriate regulations to be enforced. It shall make a preliminary report and hold public hearings thereon before submitting any final report to the Governing Body. The Governing Body shall not hold any public hearing or take action until it has received the final report of the Commission.

The Clerk shall be ex officio Clerk of the Planning Commission, and as such shall attend all meetings of the Commission. He shall keep the records and files of the Planning Commission, and shall inform it of the filing of all applications for permits, or any other matters with which the Commission may be concerned, and shall notify the members when there is business to be attended to. He shall perform such additional duties of a clerical nature as the Planning Commission may require or by regulation prescribe.

No language contained in this article establishing and governing the operation of the Garnett City Planning Commission, shall be interpreted or construed in such a way as to prevent members of the said Planning Commission from serving simultaneously as members of the Board of Zoning Appeals.
