Article 2. Fire Prevention Code

For the purpose of safeguarding life and limb, health, property and public welfare, the International Fire Code, 2018 Edition, published by the International Code Council, 4051 West Flossmoor Road, Country Club Hills, Illinois 60478-5794. Not fewer than three copies of said code shall be marked or stamped “Official Copy as adopted by Ordinance No. 4197” and to which a copy of said ordinance shall be attached, and which shall be maintained in the office of City Clerk in the City Hall of Garnett, Kansas.

It shall be the duty and responsibility of the City Manager, or his designated agent or agents to supervise and enforce the provisions of the fire code.

Any person violating the provisions of the fire code as adopted by reference by the city, or who shall fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted, and approved thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the City Manager, or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and noncompliance respectively, be guilty of a misdemeanor and upon conviction thereof, shall be fined in a sum not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00) or by imprisonment in the city jail for a period of not more than six (6) months, or by both such fine and imprisonment; provided, however, that for each and every violation of either section 10.103 or 10.104 of the said uniform fire code, there shall be imposed a fine in a sum not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) and a period of imprisonment in the city jail for a period of not less than one nor more than six (6) months, of which thirty (30) days of any such sentence shall be executed and not suspended. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten (10) days that prohibited conditions are maintained shall constitute a separate offense.
